Privacy Statement

RechtStaete Vastgoedadvocaten & Belastingadviseurs B.V. (hereinafter: “RechtStaete”) respects your privacy and processes personal data in its capacity as a controller in accordance with the General Data Protection Regulation (hereinafter: the “GDPR”).

This Privacy Statement was last amended on 24 May 2018. RechtStaete reserves the right to amend or add an addendum to this Privacy Statement unilaterally by modifying this page. We therefore recommend that you regularly consult this page. In the event that this Privacy Statement is substantially amended, we will clearly state this on our website.

What may be found in this Privacy Statement:

Personal data

“Personal data” is deemed to mean any information concerning an identified or identifiable natural person, including:

  • basic information (first and last names, prefix and titles);
  • contact details (email and postal addresses, and telephone numbers);
  • tax numbers where required for the preparation of tax returns;
  • information pertaining to the device with which you visit our website, such as an IP address;
  • information pertaining to your visit to our website;
  • any personal details which you provide to us for the purposes of a job application (first and last names, date of birth, address, telephone number, nationality, civil status and any other personal details mentioned in your job application);
  • any other personal data which you supply to us or which we may obtain for the purposes or on the grounds mentioned below.

We collect such personal data, because you have supplied it to us. For example, you may supply data when entering into an agreement with us (for example, any documentation that is required pursuant to our duty to identify you on the grounds of the WWFT [Money Laundering and Terrorism Financing (Prevention) Act]), or by entering data on our website, giving us your business card or applying for a job. We may also obtain personal data from other sources, such as a local lawyer, a counterparty, the Commercial Register, the Land Registry Office or by using public sources.

Processing purposes and grounds

RechtStaete may use your personal data for the following purposes:

  • to provide legal and tax-related services;
  • to comply with our legal obligations;
  • to enable you to comply with your tax-related obligations;
  • for marketing and business development activities, such as newsletters, invitations to our events and other marketing communications which may be important to you;
  • to deal with your job application.

We will process your personal data on the basis of one or more of the following legal grounds:

  • the execution of an agreement;
  • compliance with a legal obligation;
  • a legitimate interest;
  • your consent.

Retention period

RechtStaete will not keep your personal data for longer than is necessary to achieve the purposes stipulated in this Privacy Statement or to comply with the relevant legislation and regulations.

Sharing with others

RechtStaete may also share your personal data with other parties for the purposes mentioned in this Privacy Statement, which includes but is not confined to:

  • any other party that is relevant with regard to the legal and tax-related services which we provide, such as contracting parties, local lawyers, courts of law, regulatory bodies and government institutions (such as the Tax and Customs Administration when submitting your income tax return);
  • other parties such as regulatory authorities and other bodies for the purposes of complying with legal obligations;
  • external suppliers in connection with the processing of your personal data for the purposes described in this Privacy Statement, such as ICT suppliers, communications service providers or other suppliers to which we outsource certain supporting services.

Your personal data will only be passed on to the above-mentioned other parties for the purposes mentioned in this Privacy Statement and solely on the grounds stipulated in it.

Any third party to whom we supply your personal data will be responsible for complying with the relevant privacy legislation themselves. RechtStaete is neither responsible for nor liable in respect of such party processing your personal data. In so far as another party processes your personal data in its capacity as a RechtStaete processor, RechtStaete will enter into a processing agreement with such party which complies with the requirements stipulated in the GDPR.

In order to provide our services it may be necessary for us to pass on your personal data to a recipient in a country outside the European Economic Area. In such a case RechtStaete will ensure that such data is passed on in this way in accordance with the applicable legislation and regulations.

Security

RechtStaete has adopted appropriate technical and organisation measures to secure your personal data against wrongful or unlawful processing and against its loss, destruction, corruption, modification or disclosure. Your rights

In your capacity as a data subject you have the following rights:

  • the right to inspect. This means that you may ask to inspect the personal data that we have collected from you. You should take into account that there may be situations in which we are not authorised to comply with your request to provide a copy of your personal data, such as when we are subject to a right to claim professional privilege;
  • the right to correct your data if it is incorrect or incomplete;
  • the right to delete your personal data. In this respect you must make allowances for the fact that circumstances may occur in which we have a duty to retain your data in order to comply with our legal, tax-related and legally stipulated obligations;
  • the right to object to your personal data being processed or to restrict its processing. Once again, circumstances may occur in which we are legally entitled to decline to accede to your request;
  • the right to data portability. This means that you have the right to receive your data in a structured and accessible form that can be read by machine. Furthermore, you have the right to transfer this data to another controller;
  • the right to object to profiling;
  • the right to submit a complaint to a regulatory authority;
  • the right to withdraw any consent that has been given. Once again, circumstances may occur in which we are entitled to continue to process your data, in particular, where such processing is required to enable us to comply with our legal, tax-related or legally stipulated obligations.

Cookies

RechtStaete uses cookies on its website. A cookie is a small, simple file which is transmitted by any of the pages of this website and/or a Flash application and which your browser saves to your computer’s hard drive. The information that is stored in it may be transmitted back to our servers upon your next visit.

Use of permanent cookies

With the aid of a permanent cookie we are able to recognise our visitors’ peripheral equipment when they visit our website again. In this way it is possible for us to remember specific settings in the case of each visitor. Our website can be configured to accommodate your preferences with the aid of cookies. Even where you consent to the placement of cookies, we can remember this with the aid of a cookie. Consequently, you need not indicate your preferences again, with the result that you can save time and derive more pleasure from using our website. You may delete permanent cookies through your browser’s settings.

Use of session cookies

With the aid of a session cookie we can see which parts of our website you view during this visit. Consequently, we can adjust our services to accommodate our visitors’ web-surfing preferences as far as possible. Those cookies are automatically deleted as soon as you close your web browser.

Google Analytics

A Google cookie is placed on your computer through our website as part of its Analytics service. We use this service to record the visitors to our website and to obtain reports on how they use the website. It is possible for us to use this information to improve our website. Google may supply this information to a third party if it is legally required to do so or in so far as another party processes that data on Google’s behalf. We have no control over that. We may have permitted – implicitly or otherwise – Google to use any Analytics information for other Google services.

The information which Google collects is anonymised as far as possible. Your IP address is expressly not provided either. This information is transmitted to Google and is stored on servers in the United States. Google undertakes to abide by Safe Harbour principles and is affiliated to the Safe Harbour programme of the American Department of Commerce. This means that an appropriate level of protection is provided for the processing of any personal data.

Social widgets

Buttons may be placed on some of the pages of our website to promote (“like”) or share (“tweet”) our website on social networks such as Facebook and Twitter. Those buttons work with the aid of small sections of code sourced from Facebook and Twitter respectively, or from an intermediating party such as AddThis. Cookies are placed on your computer with the aid of this code. We have no control over that. Please read the privacy statements of AddThis, Facebook, Twitter or any other social service which is used (which may be amended regularly) to find out what they do with any personal data which they process through those cookies.

The information which they collect is anonymised as far as possible. This information is transmitted to and by Twitter, Facebook, Google+ and LinkedIn and is stored on servers in the United States. LinkedIn, Twitter, Facebook and Google+ undertake to abide by Safe Harbour principles and are affiliated to the Safe Harbour programme of the American Department of Commerce. This means that an appropriate level of protection is provided for the processing of any personal data. 

The right to inspect, correct or delete data

You are entitled to ask to inspect your data and to correct and delete it. See our contact page in this respect. We may ask you to identify yourself properly in order to prevent any abuse from occurring. Where personal data is concerned which is linked to a cookie, you will be required to send us a copy of the cookie in question as well. You may find it through your browser settings.
